NHAI Building Line and Control Line Rules
Building Permission Near National Highway Explained
4/4/20262 min read
If your land is located near a National Highway, building construction is regulated by the Government of India through the Control of National Highways (Land and Traffic) Act, 2002 ,Indian Road Congress 73-1980 and guidelines issued by the National Highways Authority of India (NHAI).
Before approving building plans, many planning authorities require NHAI NOC if the land falls within the highway restricted zone.
Recently Rajasthan High Court stated in its order that - due to illegal and uncontrolled constructions around highways, road accidents are continuously increasing, putting the lives of common people at risk.Following this, PWD has issued an order. It states that - any commercial or residential construction within 75 meters from the centre point of the National Highway will not be legally valid. All illegal structures (hotels, dhabas, shops, service centres, buildings, etc.) falling within this radius should be removed.Highway expansion projects also affected.
Along the highway, haphazard urbanisation and illegal constructions were affecting highway expansion (widening and development work). In many places, service road and flyover work is being affected.
Because illegal encroachments have occurred on the land. The court clearly stated that "Safety Over Property," meaning people's safety is more important than property.
The court also clarified that even if a construction has been permitted by a municipal body or panchayat, that permission will be considered invalid if it violates highway rules, and such constructions will be deemed illegal. (source bhaksaringlish.in)
This article explains building line and control line rules in simple terms.
1. What is Building Line and Control Line?
Two imaginary lines are defined along National Highways to control construction activities.
Building Line
The building line is a line on either side of the National Highway where no construction is allowed.
Control Line
The control line is outside the building line. Construction is allowed only after permission from NHAI between the building line and control line.
2. Standard Distance of Building Line and Control Line
As per government guidelines (general practice across India):
AreaBuilding Line DistanceControl Line DistanceUrban Area40 m from center of highway50 m from centerRural Area60 m from center of highway75 m from center
Note: Exact distances depend on the specific highway notification, so always verify with NHAI or local authority.
3. Construction Rules Near National Highway

4. When NHAI NOC is Required
You need NHAI permission for:
Commercial Buildings
Petrol Pumps
Layout / Colony Development
Industrial Buildings
Warehouses
Hotels / Resorts
Approach Road / Access Connection
Any building between Building Line and Control Line
Even entry/exit access to highway requires NHAI approval.
5. Documents Required for NHAI Permission
Generally required documents include:
Land Ownership Documents
Site Plan
Location Plan
Highway Chainage Details
Building Layout Plan
Access / Entry Exit Plan
Local Authority Permission Copy
Site Photographs
Permission is usually applied through the NHAI Regional Office.
6. Important Practical Points
These are very important for architects and developers:
Direct access to highway is usually restricted.
Service road access is preferred.
Petrol pump location has spacing requirements.
Layout approvals near highway require NHAI NOC.
Unauthorized construction can be removed by NHAI.
Boundary wall construction may also require permission in restricted zone.
7. Example for Understanding
Suppose your land is along a National Highway in an urban area:
Up to 40 m from highway center → No construction
40 m to 50 m → Construction allowed only with NHAI permission
Beyond 50 m → Normal building permission from local authority
8. Legal Reference
Main legal documents governing construction near National Highways:
Control of National Highways (Land and Traffic) Act, 2002
Ministry of Road Transport & Highways Guidelines
NHAI Access Permission Guidelines
IRC Guidelines for Roadside Development
These are the documents referred during building permission approval.
9. Conclusion
Before purchasing land or applying for building permission near a National Highway, always check:
Highway boundary

Requirement of NHAI NOC
